Terms and Conditions

These Terms and Conditions (“Agreement”) govern your participation in the AffRevolution Affiliate Program. By applying and participating in the Affiliate Program, you agree to be bound by the terms set forth in this Agreement.

1. Definitions

In this Agreement, the following terms shall bear the respective meanings:

• Affiliate: Refers to you, the person or entity who applies to participate in the Affiliate Program.
• Affiliate Account: Refers to the account created by the Affiliate upon approval to participate in the Affiliate Program.
• Affiliate Agreement: Means all the terms and conditions set out in this document, any applicable Commission Structures, and any rules or guidelines made known by the Company from time to time.
• Affiliate Application: Refers to the application made by the Affiliate to participate in the Affiliate Program.
• Affiliate Fee: The amount payable to the Affiliate based on the results and performance of their referred Customers according to the selected remuneration plan.
• Affiliate Links: Hyperlinks used by the Affiliate to link from their website or any other platform to the Company’s websites.
• Affiliate Program: The program where the Affiliate promotes the Company’s websites and creates Affiliate Links to earn commissions.
• Affiliate Wallet: An online wallet where commissions and other payments due to the Affiliate are deposited, which the Affiliate can withdraw.
• Affiliate Website: A website maintained or controlled by the Affiliate.
• Clean Net Revenue: The Net Gaming Revenue minus commission fees, royalties, jackpot shares, and administration fees.
• Commission: The percentage of the Clean Net Revenue or a fixed amount for a New Customer, as set out in the Commission Structures.
• Commission Structures: The specific payment plan agreed between the Company and the Affiliate.
• Company: AffRevolution, the entity providing marketing services for the affiliate program.
• Company Websites: Refers to all websites operated by the Company, including those owned by its subsidiaries or affiliates.
• Confidential Information: Commercially sensitive information such as financial reports, trade secrets, business strategies, and customer data.
• Intellectual Property Rights: Copyrights, trademarks, domain names, and other proprietary rights held by the Company.
• Net Gaming Revenue (NGR): The revenue generated by the Company from New Customers after deducting winnings, bonuses, fraud costs, and chargebacks.
• New Customer: A first-time customer who makes a deposit on the Company’s website, excluding affiliates, their employees, relatives, or friends.
• Parties: The Affiliate and the Company.
• Personal Data: Information that relates to a person, whether individual or legal, that can be identified directly or indirectly.
• Revenue Share: A part of the gaming revenue shared with the Affiliate, based on the performance of referred clients.

2. Affiliate Obligations and Restrictions

2.1 Joining the Affiliate Program

To join the Affiliate Program, you must accept these terms and conditions by submitting an Affiliate Application. The Affiliate Application is integral to this Agreement. By submitting your application, you agree to receive communications from the Affiliate Program.

You must be at least 18 years old to participate. The Company reserves the right to request documentation to verify your information during the application process.

2.2 Affiliate Login Details

You are responsible for the security of your login credentials. If you suspect unauthorized use of your account, you must notify the Company immediately.

2.3 Affiliate Program Participation

You may not open an Affiliate Account for a third party or transfer your account. You are required to actively promote the Company’s websites and may not use any unapproved methods or techniques.

2.4 Affiliate Website

You are responsible for the content of your Affiliate Website and ensuring it complies with all applicable laws, including the GDPR. Your website must not contain harmful or offensive content or infringe on any third-party intellectual property.

2.5 Valid Traffic and Good Faith

You must generate traffic to the Company’s websites using ethical practices. Using misleading or fraudulent methods (e.g., false claims or branded traffic) is prohibited. The Company reserves the right to freeze commissions and terminate the agreement if such practices are detected.

2.6 Affiliate Links

You must display the Affiliate Links prominently on your website. Cloaking or obscuring these links is prohibited.

2.7 Unsuitable Websites

You may not use Affiliate Links on websites that are inappropriate or illegal, such as those aimed at children, promoting discrimination, or violating any intellectual property rights.

2.8 Email and SMS Marketing

Before sending any marketing communications involving the Company’s intellectual property, you must obtain the Company’s written consent and ensure compliance with all applicable laws.

2.9 Use of Intellectual Property Rights

You may use the Company’s intellectual property only for the promotion of the Company’s websites and only in accordance with the Company’s guidelines.

2.10 Loyalty Programs

You are prohibited from offering any cash-back or similar programs unless explicitly authorized by the Company.

2.11 Responsible Gaming

You agree to promote responsible gaming practices and not target minors or individuals under the legal gambling age.

2.12 Illegal Activity

You must not target jurisdictions where gambling is illegal or engage in any illegal activities related to the Affiliate Program.

2.13 Data Protection and Cookies

Your activities must comply with applicable data protection laws, including the GDPR, and ensure proper handling of cookies.

3. Affiliate Rights

3.1 Right to Direct New Customers

We grant you the right to direct New Customers to the Company’s websites, but you are not entitled to commissions for customers secured by others.

3.2 License to Use Intellectual Property Rights

The Company grants you a non-transferable, non-exclusive license to use its intellectual property solely for the purposes of promoting its websites in accordance with this Agreement.

3.3 Players’ Personal Data

You will not have access to the personal data of players referred through your Affiliate Links, except as made available via your Affiliate Account.

4. Company Obligations

4.1 Materials and Information

The Company agrees to provide necessary promotional materials and information for you to participate in the Affiliate Program.

4.2 Monitoring Tools

The Company will provide tools for you to monitor your Affiliate Account, commissions, and payments.

4.3 Registration of New Customers

The Company has the discretion to approve or reject any New Customer referred to its websites.

5. Rights and Remedies of the Company

If the Affiliate breaches this Agreement or engages in unethical activities, the Company may terminate the Agreement, suspend the Affiliate’s participation, or withhold commissions.

6. Commission and Payment

6.1 Commission Structure

Commissions will be calculated according to the Commission Structure, which may be modified by the Company at its discretion.

6.2 Payment of Commissions

Commissions will be paid monthly and must be processed through the Affiliate Wallet. A minimum withdrawal of €20 applies.

7. Confidential Information

You agree to keep all confidential information disclosed to you by the Company in strict confidence and not disclose it to third parties.

8. Term and Termination

8.1 Term

The Agreement begins when you are approved as an Affiliate and continues until terminated by either Party.

8.2 Termination by the Company

The Company may terminate the Agreement immediately if the Affiliate fails to meet its obligations or engages in fraudulent practices.

8.3 Post-Termination

Upon termination, you must remove all Company links and materials from your website and cease all use of the Company’s intellectual property.

9. Miscellaneous

9.1 Disclaimer

The Company makes no warranties about the functionality or availability of its websites.

9.2 Indemnity

You agree to indemnify the Company against any liabilities arising from your actions.

9.3 Governing Law

This Agreement shall be governed by the laws of Greece.
